In our day-to-day business operation, we treat your name, your contact details, and any information you provided us when you interact with us digitally or in person as your personal information. This includes your interests in buying, selling, or renting properties, your attendance at an open house, your preferred locations in a house hunt, your budget, your personal circumstances, and any information you provided in our listing agreements or management agency agreements. Where relevant, we may also collect sensitive information such as information about your health or religious and philosophical beliefs, before we do this we will ask for your consent.

How we collect and hold your personal information

We obtain personal information through many ways, including:

• meetings with you;
• correspondence from you;
• documents provided by you;

• agents acting on your behalf, such as your accountants or lawyers;
• your interactions with our websites, including the use of tracking cookies;
• your interactions with us on social media;
• referrals; and
• other publicly available sources.

The purposes for which we collect, hold, use and disclose personal information

We are obliged by the Agents Regulation 2003 (ACT) and the Property and Stock Agents Regulation 2014 (NSW) to collect certain personal information from you before we can act as your agent. Depending on whether you are selling, buying, renting, or engaging our property management services, the personal information that we are obliged to collect may include:
• your name and address;
• description of your property, its conditions, and the fittings and fixtures contained therein;
• outstanding property work;
• terms and conditions of sale;
• method of sale;
• details of covenants, easements, defects, government notices or orders affecting the property;
• special instructions on marketing and showing of the property; and
• contact details of your solicitor.

We may also collect personal information from you to confirm your identity and your right to sell, buy, or entering into a property transaction. This may involve collection and use of government related identifier such as Drivers Licence number, Passport number, or Australian Business Number.
We may be prohibited by law from providing agency services to you if we are unable to collect some or all of the above information.

Generally, we collect your personal information for the primary purpose of providing property services to you and our clients. By engaging in our services or otherwise interact with our agents, you agree that we may retain and make use of your personal or sensitive information in the course of providing property services, and to receive direct marketing communications from us about those services. Our services may include providing you, and other clients of ours, analysis on current and future market trends with reference to past transaction information collected from you. In addition, when you visit one of our open houses or enquire about our listed properties, we may collect and use your personal information to provide feedback to our clients.

You have the right at any time to opt out of receiving any direct marketing material from us. Upon receiving your request, we will ensure that your personal information is not used for direct marketing purposes. To unsubscribe at any time, there is a link in our email newsletters, or you can simply reply to the email and type UNSUBSCRIBE, finally you can call our office 02 6294 9393 and ask to be removed from our mailing list. This will be done within 24 hours of your request.
If you have instructed us to engage the service from third parties such as tradespeople, solicitors, or valuers on your behalf, we will use your personal information to enquire, obtain quotes and perform all actions to facilitate the third-party service providers to deliver their contracted services.

We may be unable to provide some or any of our property services to you if we cannot collect any of the above information from you.

How you may access personal information of yourself that is held by us and seek the correction of such information

We will respond to any request to access or to correct the personal information of yourself within a reasonable period after we receive your request, it will be by 5pm the next business day.
As long as it is reasonable and practicable to do so, we will provide access to the information in the manner requested by you. Subject to prior agreement, we may also provide access to your personal information to a third-party intermediary.
We do not charge any fees upon a request to access your personal information.
We may refuse to provide access to your personal information under certain grounds prescribed in clause 12.3 of the Australian Privacy Principles, including information which will unreasonably impact on the privacy of other individuals, or relates to commercially sensitive information generated within our business. Should we decide not to give access to your personal information, we will provide a written notice to you which sets out our reasons for the refusal, and any complain mechanism.

How you may complain about a breach of the Australian Privacy Principles, and how we will deal with such a complaint

Any potential breaches of the Australian Privacy Principles will be handled seriously. Whether we are likely to disclose personal information to overseas recipients

We do not provide your information to overseas entities. Our data is stored using Australian data centers to ensure data sovereignty and compliance with Australian legislation. All current recommended security measures are used, which includes but is not limited to encryption, access controls and data breach response plans.
We may use automated processing for administrative or operational purposes; however, we do not make decisions that have legal or similarly significant effects on individuals solely through automated means.

This policy will be reviewed yearly or earlier if legislation changes or amendments are made.
